Car Accident with Three Fatalities Reported

A white Dodge Challenger was involved in a serious accident with three reported fatalities at the intersection of Lake Drive and Park Drive in Casselberry, Florida. The accident occurred near All Faiths Memorial Park shortly before 7:00 a.m. The report states that the vehicle went off the roadway and struck a tree. The car was reported to have burst into flames after hitting the tree and was fully engulfed by the time that rescuers arrived.

In Florida, passengers can sue the driver of the vehicle that they are riding in for negligence. In this particular case, the survivors of the passengers must bring an action for wrongful death for the insurance policy limits plus any assets reachable by civil judgment belonging to the driver and owner of the vehicle. The owner of the vehicle can be held vicariously responsible to pay for damages resulting from an accident such as this one under the "dangerous instrumentality" doctrine in Florida. Limits on the amount of a financial recovery against a vehicle owner can be found in section 324.021(9), Florida Statutes. More information is needed to know how the limits apply.
