Fuel Truck Runs Red Light and Causes Other Driver's Death

A fuel truck ran a red light at the intersection of Linebaugh Avenue and Sheldon Road causing the death of the driver of a 2014 Nissan SUV. Craig Allen, from Bartow, Florida, was driving a fuel truck westbound on Linebaugh Avenue when he ran a red light at approximately 5:45 a.m. on Monday. At the same time, the Nissan SUV was headed southbound on Sheldon Road. The fuel truck rolled over the SUV causing the death of the driver, who is only identified as an adult male. The news report states that alcohol was not a factor.

This accident was clearly caused the by the truck driver's failure to stop at a red light as required. Traffic lights are considered "traffic control devices" in Florida. Section 316.074, Florida statutes is cited below:

316.074 Obedience to and required traffic control devices.—

(1) The driver of any vehicle shall obey the instructions of any official traffic control device applicable thereto, placed in accordance with the provisions of this chapter, unless otherwise directed by a police officer, subject to the exceptions granted the driver of an authorized emergency vehicle in this chapter.

The truck driver's negligence resulting in the death of the Nissan driver gives rise to a wrongful death claim for the survivors of the driver of the Nissan SUV. In Florida, one person (usually a survivor) is appointed personal representative of the estate and that appointed personal representative is the person who brings the claims on behalf of all of the survivors.
