Elderly Man Hits Tree After Erratic Driving

An elderly man was reported to have run a red light at Dr. Martin Luther King, Jr. Street, North and then crashed into a tree on 54th Avenue, North. Thomas Francis Shea, 75-years-old, crashed his Nissan Sentra going eastbound at approximately 10:45 a.m. He was alone in the vehicle. The Nissan Sentra flipped after impact. Shea died at the scene of the accident.

Since this is an accidental death, an autopsy is required by law under section 406.11, Florida Statutes. An autopsy will determine whether Mr. Shea suffered from a medical emergency prior to the crash, or any other alternative theories for the erratic driving. While I am not suggesting that Mr. Shea was intoxicated, but, if he were then the autopsy should be able to reveal that. Likewise, if Mr. Shea suffered a heart attack, stroke, or diabetic shock, then there would be evidence of that as well.
In the event that the evidence leads to the conclusion that Mr. Shea suffered a sudden medical emergency, then there may not be liability for any damages caused.
