County Road 44A Fatal Car Accident

An accident occurred on County Road 44A at approximately 11:20 p.m. resulting in the death of Gail Chapin. Michael Chapin was driving westbound on County Road 44A in a Chevrolet pickup truck when he attempted to make a left hand turn onto Johns Lane and turned directly into the path of Ryan Reich, who was driving eastbound. Gail Chapin was a passenger in Michael Chapin's pickup truck. Ryan Reich's vehicle was carrying Thomas Reich and Jane Reich as passengers. Michael Chapin received serious injuries in the crash. Jane Reich also sustained serious injuries as a result of the accident.

It appears that this accident was caused by an improper left hand turn by Michael Chapin. The speeds traveled by vehicles on back country roads is often high due to the long distances that they stretch. Notwithstanding, the law on making a left hand turn is below:
Section 316.122, Florida Statutes: Vehicle turning left.—The driver of a vehicle intending to turn to the left within an intersection or into an alley, private road, or driveway shall yield the right-of-way to any vehicle approaching from the opposite direction, or vehicles lawfully passing on the left of the turning vehicle, which is within the intersection or so close thereto as to constitute an immediate hazard.
As such, Mr. Chapin had a legal duty to yield the right of way to oncoming traffic from the opposite direction before making a left hand turn. Drivers sometimes make errors in judgment on the roadway from time to time.
