Section 324.022, Florida Statutes covers a vehicle owner's responsibility for property damage and minimum insurance. As this claim only involves property damage (except for the at-fault driver's own Personal Injury Protection or PIP (no-fault) coverage), by statute she only has to have the ability to "respond in damages for liability" due to property damage in the amount of $10,000. Therefore, this driver will not have her driver's license suspended if she has the required minimum insurance or the ability to write a check for $10,000 (she could also borrow the money to save her driver's license). The only problem with this is that there may be more than $10,000 to the building and the property owner may lose more than that in lost sales due to inability to use the building during repairs. If that is the case, it is possible that the business owner may have purchased insurance to cover such losses, however, such insurance is expensive and my guess is that it was not purchased.
