This highway truck accident was likely caused by the negligence of the driver. From the information available, we do not have a report of a mechanical failure for which was not preventable or a report that this accident was due to weather. This leaves driver error as the most likely cause.

Trucks carrying sand are not exempt from regulation under 49 U.S.C. 13506(a)(6). Pursuant to 49 CFR Sec. 372.115, sand is specifically not exempt from Federal Motor Carrier Safety Regulations. Truck drivers are subject to Federal Motor Carrier Safety standards on driver qualification, vehicle inspection, and log books.
