Child Dies in Polk City, FL Accident
Polk City, Florida. Pedro Moncada was driving a 2003 Hyundai Santa Fe on State Road 33 when his vehicle went off the roadway and struck a parked semi-truck. The impact caused the death of Moncada's son. Moncada's 8-year-old son was in the front seat and was wearing his seatbelt. The accident happened at approximately 9:50 p.m. near the intersection with Greenpond Road. It is not presently known why the car left the roadway. Mr. Moncada was taken to Lakeland Regional Health Medical Center with minor injuries. The Ledger reports that both airbags deployed. A blood sample was taken for analysis.
It is a tragedy any time that a child dies in a car accident. Our hearts go out to Mr. Moncada and his family. Regardless of the circumstances of the crash, Mr. Moncada likely feels a void that will never be filled. As easy as it may be for some to rush to judgment, there are several possible causes that should be investigated in this case. While not in order of any relevance, it is possible that Mr. Moncada suffered a sudden or temporary medical emergency. At age 54, significant aging has already set in with some people. It is entirely possible that Mr. Moncada lost consciousness for a medical reason and the passenger would have tragically been unable to do anything to avoid the collision. It is also possible that the vehicle suffered a malfunction that rendered the vehicle uncontrollable. I had a car many years ago that the brakes lines rusted through pouring fluid (and my ability to stop) on the roadway. Further, crazier things could have happened such as a wheel bearing seizing, broken steering linkage, or a blown tire. If this case is a product liability case, it is more likely that a tire would have to be the cause as the vehicle appears older than permitted by the Statute of Repose in Florida in section 95.031, Florida Statutes. Without further information, it is impossible to determine possibility liability for wrongful death.
