Compelled Statements to Police for Reporting Purposes
Statements made to police are generally privileged under section 316.066, Florida Statutes. This privilege is frequently called the “accident report privilege.” As a driver is “compelled” by Florida law to give the information described by the statute above and is required by law to make a report, whatever that driver says to the police as part of the accident investigation is privileged and cannot be used in either a civil or criminal trial. Thereafter, the police may give appropriate Miranda warnings and interrogate.
